Are you good at following the rules? When running a\u00a0mobile sweepstakes, it certainly helps. In fact, it’s vital to follow the rules to avoid a problem that could cost thousands.\u00a0We’ve written before about the legal documents for a mobile sweepstakes<\/a>\u00a0and text message marketing rules<\/a>, but there are still other special\u00a0issues that may arise.\u00a0<\/span><\/p>\n

Here are some special issues that will need extra\u00a0consideration.<\/span><\/p>\n

Is it Open to Entrants Outside the US?<\/b><\/h3>\n

Is your sweepstakes open to residents of Canada? Mexico? Other countries? If so,\u00a0make sure\u00a0your official rules comply\u00a0with the laws of that region. In Canada, for example, it’s illegal to run games of pure chance with a random draw (i.e. a sweepstakes). It’s best to add a skill-testing question to make it more of a contest. In Mexico, any prize of more than\u00a0US$5,000 has to be delivered in the presence of Mexican authorities. Be sure you’re aware of the legal requirements of the region.<\/span>
\n<\/span><\/p>\n

Sending Direct Mail?<\/b><\/h3>\n

This is less common these days, but if you’re using\u00a0direct mail \u00a0to promote your sweepstakes, you\u2019ll need to make sure you have permission to send mailings to those recipients, per the Federal Trade Commission.\u00a0<\/span>The <\/span>Driver’s Privacy Protection Act<\/span><\/a> and <\/span>HIPAA<\/span><\/a> are other legal protections that prohibit the use of mailing lists from DMV records or\u00a0medical facilities for direct marketing purposes.<\/span><\/p>\n

Will it Involve User-Generated Content?<\/b><\/h3>\n

Are you asking entrants to enter with photos, videos or other material? If you’re making\u00a0use of user-generated content as an entry requirement or also for promotional purposes, put\u00a0terms in place to\u00a0cover their use with regard to copyright.<\/span><\/p>\n

Are You Targeting\u00a0Children or Minors?<\/b><\/h3>\n

When\u00a0targeting children or minors, you’re adding another layer of rules and complexity. You must take\u00a0privacy into account and other issues.\u00a0If your mobile sweepstakes will target that audience,\u00a0make sure you’re\u00a0in compliance with federal and\u00a0state\u00a0laws, including the <\/span>Children’s Online Privacy Protection Act (COPPA)<\/span><\/a> and FTC rules.<\/span><\/p>\n

Mobile sweepstakes should be carefully structured to ensure maximum participation, while minimizing the associated legal risks. Before beginning\u00a0your mobile promotion, consider the legal aspect.
